Terms of Business

These Terms of Business apply to services provided by ABC Paralegal Services [LTD] (“we”, “us”, “our”) to the client (“you”, “your”).
1. Our services
We provide paralegal support, document preparation, legal research, case organisation and McKenzie Friend assistance, as agreed with you in writing.
Before work starts, we will explain the scope of our service, the likely cost and any important limitations.
We are not a firm of solicitors and we do not undertake reserved legal activities unless we are properly authorised to do so. Our role does not replace independent legal advice from a solicitor or barrister where this is needed.
2. Your responsibilities
You agree to:

Provide accurate, complete and timely information and documents.

Tell us promptly about any relevant change in your circumstances or case.

Keep copies of documents and court correspondence where possible.

Meet court deadlines and attend hearings unless we have specifically agreed otherwise in writing.

Treat our staff respectfully and not ask us to act unlawfully, dishonestly or in a way that breaches professional obligations.
We are not responsible for delays, errors or consequences caused by incomplete, inaccurate or late information from you.
3. Fees and payment
Our fees will be confirmed before work begins or as soon as reasonably possible afterwards.
Unless otherwise agreed, payment is due [in advance / within X days of invoice]. We may ask for payment in advance before starting work or continuing with a matter.
Additional work outside the agreed scope may be charged separately. We will tell you about this before carrying it out where reasonably possible.
All prices include VAT.
4. Cancellation and refunds
If you are a consumer and enter into an agreement with us online, by phone or away from our usual business premises, you may have a legal right to cancel within 14 days.
If you ask us to begin work during that 14-day period, you may be required to pay for the work completed up to the point of cancellation. If the service has been fully performed with your express agreement, your cancellation right may no longer apply.
Refunds will be considered fairly, taking account of the work completed, costs incurred and the reason for the request.
5. McKenzie Friend assistance
Where agreed, we may attend court with you as a McKenzie Friend. Permission for a McKenzie Friend to assist at a hearing is always a matter for the court.
We cannot guarantee that the court will allow us to sit with you, provide assistance in the way requested, address the court, or take any other role. You remain responsible for your case and for complying with court directions.
6. Confidentiality and data protection
We will treat information you provide as confidential, except where disclosure is required by law, necessary to deliver the agreed service, needed to protect someone from serious harm, or authorised by you.
We process personal information in line with our Privacy Policy, available at [link to Privacy Policy].
7. Ending our service
You may end our service by notifying us in writing. We may stop acting for you where there is a conflict of interest, non-payment, a breakdown in trust, abusive behaviour, unlawful instructions, or another good reason.
You remain responsible for fees and costs incurred up to the date the service ends.
8. Complaints
If you are unhappy with any aspect of our service, please follow our Complaints Procedure.
9. Liability
We will provide our services with reasonable care and skill. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
To the extent permitted by law, we are not liable for indirect losses, loss caused by your failure to provide accurate or timely information, or outcomes determined by a court, tribunal or third party.
10. Governing law
These Terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales.

Complaints Procedure

ABC Paralegal Services aims to provide a professional, clear and respectful service. If you are unhappy with any aspect of our service, please tell us. We take complaints seriously and will deal with them fairly.
1. How to make a complaint

2. Our process
We will acknowledge your complaint within five working days of receiving it.
We will investigate the complaint and aim to provide a written response within 14 working days. If we need more time, we will tell you why and give you a revised response date.
Our response will explain:

Our findings.

Any action we propose to take.

Any further options available to you.
3. If you remain unhappy
.Please make this known within 14 days of our final response. We will acknowledge the review request within five working days and aim to provide a final written response within 14 working days.
4. External options
If you remain unhappy after our final response, you may be able to seek independent advice or take the matter to an appropriate external body.
Concerns about personal information can be raised with the UK Information Commissioner’s Office: ico.org.uk.
5. No charge
We do not charge for handling a complaint.
6. Keeping records
We keep a record of complaints so we can investigate them properly and improve our service. We handle complaint information in accordance with our Privacy Policy.
